End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User") and KinLink ("Licensor") for the KinLink mobile application ("App") distributed through the Apple App Store. This EULA incorporates and supplements the KinLink Terms of Service and Privacy Policy.

By downloading or using the App, you agree to this EULA. If you do not agree, do not download or use the App.

1. License Grant

Subject to your compliance with this EULA, KinLink grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

2. Restrictions

You may not:

Copy, modify, or create derivative works of the App.
Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law.
Rent, lease, sell, sublicense, or transfer your rights under this EULA.
Remove or alter any proprietary notices, labels, or marks on the App.
Use the App for any unlawful purpose or in any manner inconsistent with this EULA or our Terms of Service.

3. Beta and Pre-Release Software

Prior to the App's general release on the App Store, KinLink may distribute pre-release versions via Apple TestFlight. Beta versions may be unstable, incomplete, or contain errors. Beta software is provided "as is" without warranty of any kind. Do not rely on beta versions for critical safety purposes. KinLink may terminate beta access at any time.

4. Location Services

The App requests access to your device's location services, including background location access, to enable its core features. You may revoke location permissions at any time through your device settings, but doing so will disable geo-fence alerts and other location-dependent features. By granting location access, you acknowledge and consent to the collection and use of location data as described in our Privacy Policy.

5. Apple App Store Terms

This EULA is an agreement between you and KinLink only, not Apple, Inc. ("Apple"). Apple is not a party to this EULA and has no obligation to provide maintenance, support, or warranty services for the App.

Warranty: In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product liability: KinLink, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, consumer protection claims, and intellectual property infringement claims.
Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple has the right to enforce this EULA against you as a third-party beneficiary.
Compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government prohibited or restricted parties list.

6. Third-Party Services

The App integrates with third-party services (including mapping, analytics, and communication services). Your use of those services is subject to their respective terms and privacy policies. KinLink is not responsible for the practices of third-party services.

7. Privacy

Your use of the App is subject to KinLink's Privacy Policy, available at kinlinkapp.com/legal/privacy-policy. The App collects location data and other information as described in that policy. By using the App, you consent to such collection and use.

8. Intellectual Property

The App and all content, features, and functionality are owned by KinLink and protected by United States and international copyright, trademark, and other intellectual property laws. This EULA does not grant you any intellectual property rights in the App beyond the limited license described in Section 1.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. KINLINK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KINLINK DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT LOCATION DATA WILL BE ACCURATE AT ALL TIMES.

10. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, KINLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT SHALL KINLINK'S TOTAL LIABILITY TO YOU EXCEED $100.

11. Termination

This EULA is effective until terminated. Your rights under this EULA terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

12. Governing Law

This EULA is governed by the laws of the State of California, without regard to conflict of law principles.
